Biography

Smith was prosecuted alongside other striking miners in connection with the same eastern Kentucky coal-truck ambush during a labor conflict. The case focused on an armed assault on trucks hauling coal during the strike, viewed by prosecutors as an intentional attack on interstate-commerce transportation that carried an obvious risk of lethal harm.

He was convicted in federal court under the statute criminalizing the damaging of motor vehicles used in interstate commerce when done with reckless disregard for human safety. The case has remained a reference point for how the federal system approached strike-linked violence, treating the incident as both sabotage of commerce and a grave act of endangerment.
