Biography
Benamar Benatta is an Algerian refugee claimant whose case became widely cited in discussions of post-9/11 detention practices. After seeking refuge at the Canada–U.S. border shortly before the September 11 attacks, he was transferred into U.S. custody the day after 9/11 and treated as a terrorism suspect in the climate of emergency policing that followed.
Although authorities later concluded he was not involved in terrorism, he remained detained for years while immigration proceedings unfolded, including periods of harsh confinement that he and advocates described as punitive. He was ultimately returned to Canada after nearly five years, and his experience became emblematic of the civil-liberties consequences of sweeping national security measures in the early “war on terror” period in the United States.
